what do you mean by fail? it could be a ABS system kicking in when not fully needed. they will seem to push a little further down. but never fail completely. you may just want to take it in to the dealership. it could just mean you need new brakes, leak of fluid or something pretty simple. And for a recall, they have to have a certain number of people complain and need the same part replaced before the part or item is recalled, its not a simple process. best advice is to take it in to the dealership and let them help you out.
