You may be driving with the shifter in the wrong position, sounds like. Make sure it's in "D" and if that isn't the problem, return to where you purchased it and get this documented.
It's important to get it in writing that you have a concern, so that if the problem gets worse, or the transmission goes out after the warranty ends, they can't deny you repairs.
You can say "LOOK, this problem has been going on for quite a while now, and it's not fixed yet. I have documentation to prove it"
